Boonville Amends Village Code: Residents Required To Trim Grass, Vegetation, Rid Of Unsightly Debris Next To Road

Boonville recently amended a Village Code, as released from village Mayor, Eric McIntyre.


§290-3. Vehicle sight distance protected; removal of debris. [Amended 4-10-2017]
All property owners within the Village of Boonville who own property abutting Village streets, County roads or State highways must keep the grass, hay or other vegetation cut to a height at or below 10” as to not obstruct the view of motorists using said Village street or highways; and further, said owner shall keep the vacant lot free from unsightly debris, such as logs, crates, boxes, papers and other materials, which may cause a fire and aid a fire to spread to adjoining property owners.

All property owners within the Village of Boonville must keep the grass, hay or other vegetation cut to a height at or below 10” as to not increase the chance of attracting rodents which may cross onto the property of adjoining property owners; and further, said owner shall keep the vacant lot free from unsightly debris, such as logs, crates, boxes, papers and other materials, which may cause a fire and aid a fire to spread to adjoining property owners.

§290-4. Right of Village to clear; assessment of costs against owner. [Amended 4-10-2017]
If the Village of Boonville, through its Superintendent of Streets, uses its equipment to trim, cut or free a lot of debris, grass, hay or other vegetation above mentioned, or hires a third party to do so, the charge for labor and equipment rental will be assessed to the property owner. The Village will first provide a courtesy notice to correct the defect by sending the Notice by certified mail to the reputed owner at the address of record. If the defect is not cured within 48 hours of the Post Office’s first attempt of delivery then the Village may proceed with the enforcement of this Article. Actual receipt of the Notice is not necessary to proceed; attempted delivery of the Notice is sufficient.

§290-5. Penalties for offenses. [Amended 12-29-1971] [Amended 4-10-2017]
Any person violating any of the provisions of this ordinance shall be punished, upon conviction, by a fine not exceeding $300.00 for each violation. In addition, each violation of this enactment shall constitute disorderly conduct and each person violating the same shall be a disorderly person. Each day that the violation or failure to comply with any provision of this enactment or any regulation promulgated here-under by the Board of Trustees occurs shall constitute a separate and distinct violation.
