SYRACUSE- New York’s COVID vaccine mandate for state health workers is “null, void and of no effect,” according to a State Supreme Court Justice in Syracuse, NY.
Judge Gerard Neri says Governor Kathy Hochul and her State Health Department went beyond their legal means in this mandate by dodging the legislative chambers.
This development is being reported by Syracuse.com.
The mandate has riled-up numerous lawsuits and need for court intervention. The mandate was first enacted back in August, 2021.
It’s important to note that during the pandemic, the legislature had granted emergency powers to then Governor Cuomo.
Those powers ceased in June, 2021 and exactly a year later, the health department made the mandate permanent for health workers.
The state argued their mandate was not “unreasonable” or “irrational.” However, Judge Neri disagreed and ruled the state had no authority in making the mandate permanent.
