Some aspects of New York’s latest list of gun laws will stand, while others will be blocked in latest decision by U.S. Circuit Court of Appeals

ALBANY, NY- A 261-page decision, based on a panel of three judges in the 2nd U.S. Circuit Court of Appeals, will allow certain aspects from New York’s latest list of gun laws to stand, while others have been blocked.

This development is according to the Associated Press.

With the ruling determined on Friday, it marks the first broad review of the latest gun laws passed through the state legislature in response to a turning point Supreme Court ruling from last-year.

In summary, according to this latest ruling, the state of New York may continue with banning firearms from what is defined as “sensitive” locations, while also requiring that handgun owners be of “good moral character.”

However, the court ultimately rejected in their ruling a requirement for applicants for a handgun license to hand over a list of social media accounts, citing free speech concerns.

In addition, the ruling denied a ban on people bringing firearms into a place of worship, citing the state may have violated religious liberty by creating a separate set of regulations for places like churches, synagogues, mosques and etc.

Furthermore, the decision states that New York cannot enforce the law where it was a crime to conceal carry on private property, without the express consent of the owner, a restriction that would have kept firearms out of places like shops, supermarkets and restaurants unless the proprietor put a sign up saying guns were welcome.

Despite a flurry of numerous lawsuits that have blossomed over this ongoing legal battle, Governor Kathy Hochul said this ruling is a victory and that the “core tenets of our laws remain in effect.”
