New York Attorney General to appeal State Supreme Court decision to block abortion rights amendment from November ballot

ALBANY, NY- New York’s Attorney General Letitia James says she will appeal a State Supreme Court decision that would ultimately strike down an abortion rights amendment from appearing to voters on the November ballot.

This development is according to previous reports from the Associated Press this week.

For context, it’s reported that Justice Daniel J. Doyle made note how state lawmakers did not successfully adhere to procedural rules regarding the passing of constitutional amendments.

Specifically, the judge pointed out how the legislature incorrectly approved the amendment prior to achieving a written opinion on the language via the Attorney General’s Office.

During the winter of 2023, Democrats in the state legislature passed the Equal Protection of Law Amendment, which was designed to prevent discrimination based on pregnancy outcomes or gender expression.

The measure was ultimately brought forth to protect abortion rights and an individual’s right to seek gender affirming care.

In a statement released to social media, Attorney General James says Judge Doyle’s decision was “disappointing” and her office will appeal to “defend New Yorker’s rights.”
