No criminal charges in wake of fatal motorcycle accident in Western Adirondacks

WEBB- There will be no criminal charges filed in the wake of last Thursday’s fatal motorcycle accident in Herkimer County.

In a follow up to our original report, a 39-year-old male from New Jersey, who was unidentified by police, suffered from what emergency responders described as severe head trauma.

The victim was found along State Route 28 in the town of Webb sometime shortly before 1:00 p.m. and was rushed to an awaiting Lifenet Helicopter.

The male motorcyclist was flown to SUNY Upstate Medical Center, but did pass away despite the best efforts from emergency personnel.

According to Town of Webb Police Chief Jason T. Mulcahy, the male victim was operating a 2004 Harley Davidson southbound and tried passing another vehicle in a no passing zone. The motorcyclist subsequently struck an oncoming northbound vehicle. The impact caused the male to be thrown from his bike.

The driver of the oncoming vehicle was not injured from the crash and remained on-scene to cooperate with police.

Though the victim is from the state of New Jersey, he was recently staying in the Old Forge, NY area, police said.
