
LOWVILLE- The local man who is a registered sex offender, accused of trying to lure a group of children to his vehicle, has taken a plea deal and will spend the next-three months in jail.
According to the office of Lewis County District Attorney, Jeffery G. Tompkins, Dwayne E. Kirk, 58, appeared in West Turin Town Court on Thursday and pleaded guilty to a misdemeanor charge of stalking in the fourth-degree.
He was charged last-week for trying to lure three children to his vehicle in the village of Constableville, NY. Police said Kirk went as far to throw money at the children in his attempts to lure them.
After submitting his guilty plea, Kirk was sentenced to 89-days in jail. Meanwhile, orders of protection have been issued on behalf of all three juveniles.
In terms of the sentence, Tompkins’ office claims the maximum sentence prosecutors could have asked for was only three-months. “Avoiding the long, drawn out process of a trial by securing a guilty plea to the top charge with a jail sentence of only one day less than the maximum allowed by law is victory,” DA Tompkins said in a news release.
Only a few days after Kirk was arrested and charged by the Lewis County Sheriff’s Office, he was taken in by the Oneida County Sheriff’s Office over discrepancies involving his place of residency.
